ottenere il certificato di oblio oncologico. Il provvedimento era atteso dopo il decreto, pubblicato lo scorso aprile, con l'elenco delle patologie oncologiche per le quali si applicano termini inferiori rispetto a quelli previsti dalla legge sull'oblio oncologico del 2023 e rappresenta il provvedimento che rende operativo il diritto a veder cancellati alcuni limiti fino ad ora applicati per coloro che avevano avuto una malattia oncologica, dai mutui alle adozioni. Nell'articolo 1 del nuovo decreto si stabilisce che "il soggetto interessato, già paziente oncologico", presenti "istanza eventualmente corredata dalla relativa documentazione medica, di rilascio del certificato che attesta l'avvenuto oblio oncologico, a una struttura sanitaria pubblica o privata accreditata o ad un medico dipendente del Servizio sanitario nazionale nella disciplina attinente alla patologia oncologica di cui si chiede l'oblio o al medico di medicina generale oppure al pediatra di libera scelta, che forniscono all'interessato le informazioni di cui all'art. 13 del regolamento (UE) 2016/679".La certificazione - si legge nell'articolo 2 - è rilasciata entro trenta giorni dalla richiesta se sussistono, a giudizio della struttura o del medico certificante, i presupposti temporali (decennali o quinquennali) richiesti dalla legge n. 193 del 2023 e quelli previsti nei successivi decreti attuativi della medesima legge con i quali sono indicati, per specifiche patologie oncologiche, termini inferiori di guarigione". Inoltre "ai fini della tutela dei dati personali, l'istanza e i relativi allegati sono cancellati trascorsi dieci anni.
